What is the land share mentioned in your flat’s deed?

Your apartment papers may describe both a home and an undivided share of land. Here’s where to begin.

Read the apartment description and the land-share entry together. A lawyer can check how they connect to the underlying land and other transaction records.

There is more in the schedule than the flat number

It is natural to focus on the floor, view and usable space. The deed may also describe an interest in the land under the development. Keep that entry visible when comparing the seller’s deed and your draft. If the numbers or descriptions change, ask for an explanation before accepting the new version. Do not work out ownership rights from a brochure’s area figures alone.

Keep marketing measurements out of the comparison

The area shown on a brochure may use a different description from the area in the deed. Copy the exact labels as well as the figures when asking about a difference. A question such as “Why is this called an undivided share here?” is more useful than comparing two numbers without saying what each number describes.

Checks to keep with your file

  • Locate the land schedule and apartment schedule.
  • Note the undivided-share figure exactly as recorded.
  • Compare the proposed draft with the seller’s deed.
  • Flag any missing annexure or unexplained change.

The next step

Mark the land-share entries in the existing deed and proposed draft. Ask the reviewer to explain any difference in terms you can understand.

Can I calculate the correct share just from the apartment area?

Do not assume a simple calculation resolves it. The project and title documents, and the actual instrument, need to be considered.
