Property documents / GUIDE

The EC says “nil”. Can you stop worrying?

A nil result can sound reassuring. Understand the limits of the search before treating it as an answer to everything.

An EC reflects the records covered by its search details and period. A nil result is not, by itself, a full legal assessment of the property or every possible claim.

First check what was searched

Look at the property identifiers and dates on the certificate. If those do not fit the property or the reason you requested it, the result may not answer your question. Keep the EC with the deeds and other records rather than reading it in isolation. If a seller says it proves everything is clear, ask the reviewing lawyer what else should be considered.

Read the search details as carefully as the result

Check the property description and the period for which the certificate was obtained. If a survey number is wrong or the period stops before a relevant transaction, a reassuring result may not answer the question you intended to ask. Keep the EC with the deeds it is being compared against; a certificate forwarded on its own loses that context.

For a purchase, ask the reviewing lawyer what other records are needed alongside the EC. You are looking for an explanation of the property file as a whole, not simply a document carrying the word “nil”.

Details to check

  • Confirm the property description and search period.
  • Compare available entries with the deeds supplied.
  • Flag an expected transaction that does not appear.
  • Ask for advice on unclear or unexpected entries.

The next step

Have the search details and any entries read alongside the property documents. Ask which questions the EC answers and which still need checking.

Does a nil result mean the property has no risk?

No such guarantee follows from the result alone. The search scope and wider documentary position still matter.
