You’ve signed the agreement. What comes next?

The agreement and final deed belong to different stages of the purchase. Keep track of what each records.

A sale agreement records terms for the proposed transaction; the sale deed is a different instrument used to record the transfer. Ask how your agreed obligations carry into the final document.

Keep the promises visible

By the time the deed arrives, you may have exchanged months of messages about payments, possession and documents. Put the agreement beside the proposed deed and identify anything still to be completed. Tell the drafter about changes agreed since the first document. Do not assume a promise survives in the form you expect simply because it appeared in an earlier conversation.

Do not leave the agreement behind

When the sale deed arrives, keep the signed agreement beside it. Compare the price, payments already made, balance payable and possession arrangement. Mark anything that has changed since the agreement and ask why. Verbal changes discussed during the purchase should be explained to the drafter; otherwise the final deed may be prepared from an earlier understanding.

Before the appointment

  • Keep the signed agreement and all relevant annexures.
  • Compare key terms with the proposed sale deed.
  • Identify conditions that remain unfulfilled.
  • Record the explanation for any agreed change.

The next step

Ask the reviewer what remains to be done under the agreement before you sign the deed, and where the final arrangements are recorded.

Can the final deed be copied from the agreement?

The documents have different functions and drafting requirements. Use the agreed terms as inputs, then have the appropriate instrument prepared and reviewed.
