Ownership & transfers / GUIDE

Preparing for a family property division?

Before discussing boundaries or shares, put the property history and everyone’s understanding together.

Gather title papers, earlier family arrangements and a clear list of the properties and people involved. Note areas of agreement and disagreement separately.

Separate the shared facts from the proposed arrangement

Families may use familiar descriptions such as “the back portion” or “our grandfather’s land”. The documents need a more precise picture. Keep addresses, survey details and available plans with the ownership records. Explain whether anyone occupies, rents or has borrowed against part of the property. If there is disagreement about rights, it needs legal advice before a proposed division is treated as settled.

Keep the property list separate from proposed shares

First identify the properties under discussion and the available ownership records. Then note each proposed arrangement and any unresolved point. This helps everyone see whether they are discussing the same assets. Include occupation, loans and earlier family documents where relevant. A rough sketch may help explain a proposal, but label it as a discussion aid rather than an agreed division.

Points to work through

  • Identify every property included in the discussion.
  • Provide documents supporting the existing interests.
  • Explain proposed allocations and access arrangements.
  • Disclose disagreement, occupation or third-party interests.

The next step

Bring the records to a consultation and ask which issues must be resolved first. Avoid signing a draft just because it appears to reflect a family conversation.

Can an equal division of area be assumed to resolve everything?

Not necessarily. The interests, value, access, practical use and applicable requirements may all need consideration.
