Ownership & transfers / GUIDE

Selling a property with other owners? Start together.

A buyer may be ready while the owners are still working out the details. Get those conversations aligned early.

Identify every person with an interest in the property, the records describing that interest and the proposed signing arrangements. Clarify disagreements before treating the sale as ready.

Put everyone’s position on the same page

One co-owner may be handling the calls while another lives elsewhere. That can be practical, but the buyer and drafter still need to understand the ownership and authority. Gather the relevant deeds and any family documents. Talk about payment, possession and availability rather than assuming everyone shares the same expectations. If there is a disagreement, seek advice before making commitments on another person’s behalf.

Make the shared decisions visible

Before a draft is prepared, discuss the proposed price, payment arrangements, attendance and who is handling communication. Record points that still need agreement. One owner volunteering to coordinate does not remove the need to understand everyone’s position. If someone is abroad or unavailable, mention it early so the signing arrangements can be considered before a date is fixed.

Points to work through

  • Provide the title documents showing the interests.
  • Identify each proposed signatory and representative.
  • Record any existing agreement among co-owners.
  • Explain disagreements or unavailable parties without omitting them.

The next step

Prepare a list of owners, records and unresolved points. Ask what consent and authority need to be checked before the sale moves forward.

Is consent in a family group chat sufficient?

Do not rely on an informal message as a substitute for the documentation and execution required for the particular transaction.
