What the work involves
- Trace the available ownership records to the person selling to you.
- Check that the flat, land share and other descriptions connect.
- Raise questions about an existing loan and the release of original documents.
- Identify what the seller needs to clarify before your next payment.
Keep the seller’s file and the apartment records together
The seller may have one set of papers and the association or lender another. Make a list of who holds what. Include any existing loan, occupation or handover arrangement that affects the proposed sale, rather than assuming those matters can wait until after the document review.
A useful purchase file also retains the agreed price, payment schedule and items promised at handover. These do not replace the title papers, but they help explain the transaction being reviewed. If the seller is still living in the flat, put the proposed possession arrangement in writing for the drafter to consider.
Documents to have available
- Seller’s deed and earlier chain documents
- Available EC, khata and tax records
- Apartment schedule, approvals and occupancy-related records
- Loan-closure information, if the property is mortgaged
Write down what you have agreed about vacant possession, parking, fixtures and unpaid dues. These details are easy to lose in calls with the owner or broker. Keep them beside the document file so the agreement can be checked against the purchase you actually expect to make.
Before work begins
You’ll know whether the work includes seller questions, agreement comments and registration assistance as well as the document review. Tell us your proposed payment date so we can discuss a realistic sequence.
Questions about property verification
The flat has a home loan. Should I be worried?
An existing loan is something to plan for carefully. We’ll need to understand the lender’s position, where the originals are held and how payment and release are proposed. Raise it early, before fixing the payment sequence.
Can the review begin while some association papers are pending?
You can discuss the scope and share the available file. Keep the missing items listed and ask the advocate which conclusions depend on them. Starting a review is different from completing it.
