Deeds & agreements / GUIDE

Thinking about a will? You can begin with a few notes.

You do not need a finished plan before asking for a confidential discussion.

Write down your assets, the people you want to provide for and the questions you find difficult. Mention any earlier will or relevant family arrangement to the lawyer.

Leave room for the questions you haven’t settled

You may feel clear about some wishes and uncertain about others. Mark those separately instead of forcing a decision before you have advice. Think about who would know where the completed document is kept. If circumstances have changed since an earlier will, explain what changed and when. Keep the notes private and share them only through the channel agreed for the consultation.

Your first notes do not need legal wording

List the assets you want to discuss, where the supporting records are kept and the people whose circumstances you want considered. Keep wishes separate from assumptions about what you own. If a property is shared, say so. You can explain a concern in ordinary language; the consultation is where its legal implications and the appropriate wording should be considered.

Points to work through

  • Identify earlier wills or related arrangements.
  • Describe assets accurately without sharing them publicly.
  • List the intended arrangements and unresolved questions.
  • Discuss execution, custody and future changes.

The next step

Arrange the discussion first. Use your notes to make sure the important concerns are covered, then ask how the final document should be signed and kept.

Will registration alone settle every validity question?

Do not assume that it does. The contents, circumstances and execution of the will still require appropriate professional consideration.
