Deeds & agreements / GUIDE

A family transfer: do you need a gift or a release?

Start with what the family wants to achieve. The name of the document comes after the facts.

Explain who currently has an interest in the property and what each person intends to give up or receive. A lawyer can then advise which instrument fits the arrangement.

Describe the outcome in ordinary words

You might want to give a home to a child, settle a shared interest or record an arrangement among siblings. These can involve different rights even if everyone calls them a “transfer”. Gather the title papers and earlier family documents. Say whether anyone will keep living in the property or expects conditions to apply. Those details are central to choosing the route.

Describe the arrangement before choosing the label

Write down who owns an interest now, who is intended to receive it and whether money is changing hands. Mention any expectation about living in the property or receiving support. Those facts are more useful to the adviser than a downloaded format called “gift” or “release”. Ask for the reason behind the recommended instrument before arranging signatures.

Points to work through

  • Identify the current interests from the records.
  • Explain who is intended to hold what after the transaction.
  • Disclose relevant family or succession documents.
  • Ask for advice on the legal effect and current charges.

The next step

Ask for the proposed document and its effect to be explained before discussing only fees or a registration date. Every person involved should understand the arrangement.

Can a lower-charge instrument be used regardless of the facts?

No. The instrument must fit the legal nature of the transaction. Charges are one consideration, not a substitute for that assessment.
